Legal Current Affairs 2025 Intro

Priya introduces the video as a monthly legal update, promising to explain important legal news and judgments. The video aims to provide viewers with new insights and knowledge on current legal topics.

Census 2027

India will conduct a census starting March 1, 2027, after a 16-year gap. A census is an official nationwide survey collecting data such as name, age, gender, education, religion, and housing details. This data informs the design of Parliament seats, reservation policies, and welfare schemes. The 2027 census will be India's first fully digital census, offering a self-enumeration option. Additionally, a caste census will be conducted after nearly a century, collecting data on SC, ST, and OBC categories. This data will be used to provide quotas and make policies based on concrete information. The caste census data may lead to new reservation claims, revision of the 50% reservation limit set by the Supreme Court, further sub-categorization within SC/ST categories, and the exclusion of the creamy layer from OBC reservations.

Delimitation Explained

Delimitation, which starts after the census, involves deciding the number of seats each state will have in the Lok Sabha based on population to ensure every vote has equal value. If a constituency's population has increased or decreased, the boundaries of Lok Sabha and Assembly constituencies are redrawn. This process is carried out by the Delimitation Committee, an independent body whose decisions are final and cannot be changed by Parliament or reviewed by the court. The committee includes a retired Supreme Court judge, the Chief Election Commissioner, and state election commissioners. Southern states worry that delimitation based on population could give Northern states more Lok Sabha seats, leading to a political power imbalance. This concern arises from the fact that Southern states responsibly implemented family planning programs, controlling their population, unlike Northern states.

Property Registration Case | Mahnoor Fatima case 2025

The Mahnoor Fatima case involves a property dispute where A sells a property to B in 1982 with a sale agreement that is not registered. Sections 17 and 49 of the Registration Act 1908 mandate that registration is compulsory for the title transfer of any property to be complete, and unregistered documents cannot be used as evidence in court. B then sells the property to a builder, who registers the sale agreement, and the builder sells it to Mahnoor Fatima, also registering the sale agreement. The Supreme Court reiterated that since the initial agreement of 1982 was invalid due to lack of registration, all subsequent transactions are also invalid. The court emphasized that establishing ownership requires a lawful and valid title, not just registration.

Right to Narco-Test | Amlesh Kumar case 2025

The Amlesh Kumar case discusses the validity of narco-analysis tests. The accused, charged with murder and harassment, had the Patna High Court allow a narco-analysis test. A narco test involves inducing Sodium Pentothal, causing the person to speak their subconscious thoughts. The Supreme Court, referencing the Selvi versus State of Karnataka case (2010), stated that forcibly subjecting an accused to a narco-analysis test violates their right to personal liberty and self-incrimination (Article 21 and Article 20(3)). Conducting a narco test without consent also violates mental privacy. However, the court raised the question of whether an accused can demand a narco test to prove their innocence. The court said that if the accused is presenting evidence at the time of trial then he can request for narco test. This request is not an absolute right and can be denied by the court.

Personality Rights Judgment | Sadhguru case 2025

Personality rights, or publicity rights, protect an individual's voice, unique style, look, appearance, and image from unauthorized commercial use. Sadhguru approached the Delhi High Court to protect his personality rights after AI-generated misleading messages were created using his voice and video. The laws regarding personality rights in India are not very clear, with protection mainly available under Article 21 (right to privacy and personal liberty) and within the concepts of passing off and defamation in tort law. The High Court recognized Sadhguru's unique style and image as his identity and ordered the suspension of YouTube channels and websites producing misleading messages using AI tools and infringing on his personality rights.

Iran-Israel War | Operation Rising Lion

Israel launched Operation Rising Lion, directly attacking Iran's nuclear plants and military sites to prevent Iran from developing nuclear bombs. Iran and Israel have a 40-year rivalry, with Iran considering Israel an illegitimate country built on Palestinian land. Iran supports groups fighting against Israel, such as Hamas, Hezbollah, and Houthis, providing them with money, weapons, and training. Israel aims to eliminate these proxies to reduce Iran's influence in the Middle East.

Ahmedabad Plane Crash & Montreal Convention

An Air India flight from Ahmedabad to London crashed near Sardar Vallabhbhai Patel Airport in Ahmedabad, resulting in 250 deaths. The investigation into the cause of the crash is ongoing. Such incidents are governed by the Montreal Convention and India's Carriage by Air Act, which follow the law of strict liability. This means that regardless of fault, the victim's family will receive compensation: Rs 1.85 crore as per the Montreal Convention and Rs 1.32 crore as per the Carriage by Air Act. Air India will have to match these compensation values.

0:00 There are two strong reasons that make the census to be held in 2027 historic. But the truth is that caste had never gone out of the system. The court asked whether an accused can demand a narco test for his own defence to prove his innocence? Hey everybody, I am Priya and welcome to this video of Monthly Legal Updates in which we are going to understand the important legal updates, legal news and important judgements of the entire month. So you are going to learn many new things in this video. Let's get it started. So congratulations because after 16 years, finally census is going to be conducted in India. Which is going to start from 1st March 2027. But what is this census? So simply put, Census is an official survey conducted across the country

0:46 in which the government goes door to door and collects important data. Like your name, age, gender, educational qualification, your religion, migration, history. Along with this, what size of house do you live in, do you live in a mud house or a pucca house. Internet connection, water supply, electricity, all this data is collected. So Census is not just a head count but a way to better understand the demographics of the country. On the basis of which, Parliament seats, reservation policies, welfare schemes etc. are designed in future. So, the senses themselves become a strong foundation for the planning, policy making and development programmes of the country in the future. Now, the census should be done once every 10 years. Meaning, after 2011, the next census should have been held in 202. But it got delayed due to the pandemic. But apart from this, there are two such strong

1:31 reasons which make the census to be held in 2027 historic. Let us know. Firstly, this is going to be India's first fully digital sense. Where self enumeration option will be available. Meaning, if you want, you can log in to the government portal and provide your family details yourself. Secondly, caste census is going to be conducted in India after almost 100 years. So when did the last cast sense happen ? In 1931. Because since independence, India has been consciously avoiding caste count. Because we had to avoid social division. But the truth is that caste had never gone out of the system. Be it education, employment or politics, caste plays a major role in everything. And so in 2027, finally, caste sense is going to happen. Meaning, in the census, people's caste will be asked in which

2:20 data of SC, ST, OBC and their classes will be collected. Now why is this such an important matter? Understand it like this that the OBC quota that was being given in India till now was being given only on an estimated basis. For the first time, quota will be given on the basis of data. For the first time, policies will be made on the basis of data. So what impact will the data coming from caste census have ? First new reservation claims may come. Like Jats, Patels, Marathas can get data support. Secondly, the 50% reservation limit imposed by the Supreme Court can be revised. Sub-categorization can be further cleared within the third SC ST category also. And last in 1992 Indira Sawhney case it was said that to exclude creamy layer from reservation in OBC it is necessary to have data which can be obtained from this caste sense. So all in all senses and caste

3:07 senses are two very important topics. Keep reading about it. Now let us understand the next topic with the same ease. So as soon as the process of sensex is completed, the process of delimitation will start. Now till a few days ago I also did not know much about this topic. So if you also do not know about any topic then do not feel low , do not take stress. Rather, celebrate the efforts you are putting in to understand that topic and the determination you are showing. So celebrate your progress over perfection and with that spirit let us understand delimitation easily. So for this you should have a general idea about how many seats will be there from which state in the Lok Sabha. How is this decided? According to its population. Just keep this in mind. So what happens in de limitation? According to the census data, it is decided

3:52 how many seats will come from which state so that every vote has equal value. So the main aim of de limitation is that every vote should have equal value. So, as per the sense, if it is found that the population in a constituency has increased, whereas the population in some area has decreased, then the boundaries of the Lok Sabha and Assembly constituencies are redrawn accordingly. Why? So that the representation of each area is according to its current population. So for example, if the population of any state is increasing then its Lok Sabha seats will be increased. So if the population of UP is increasing then its seats in the Lok Sabha will become 80. At the same time, if the population of any state is decreasing then its seats in the Lok Sabha will be reduced. So if the population of Kerala is decreasing, then their seats in Lok Sabha will become 20 and this is the entire process of delimitation

4:39 and this entire process is carried out by the Delimitation Committee which is an independent body whose decision is final. It is final, meaning neither the Parliament can change it nor the court can review it. And this committee consists of a retired Supreme Court judge, Chief Election Commissioner and Variance State Election Commissioners. Now that you have understood the whole process of delimitation, tell me what problems can the Southern states face due to this process ? So the Southern states say that through this delimitation on the basis of population, the Northern states can get more seats in the Lok Sabha. Meaning, the North can get more power compared to the South. Now to understand this whole issue, we have to understand 1971 from two reasons. Firstly, in the census of 1971, it was revealed that the

5:25 population of India was increasing dangerously and around this time, the government was promoting different family planning programmes. So keeping these two things in mind, the Southern states responsibly implemented family planning programs and brought their population under control, which was not possible in the Northern states. So now the Southern states are saying that if the Lok Sabha seats are being decided on the basis of population, then definitely the Northern states will get more seats, which could create a political power imbalance between the South and the North. So this was delimitation and the problems faced by the Southern States because of it. So, you have understood the topic which you did not know till two minutes ago. Happy? I am very happy. Let's move on. Now I and the entire Finology Legal Team start working every day from 10:00 AM onwards reading different news update cases,

6:12 looking at different references so that you don't have to do all these things. So if you are preparing for CLAT PG exam, you also have two main tensions in your mind. Firstly, how to cover the entire syllabus in the next 5 months and how to manage the time, then you have to trust me. You have to check out the courses on CLAT PG. And I will give you just three reasons. If it matches what you are looking for then you can check out the course. First we help you not feel overwhelmed. So we will not ask you to casually read 100-100 pages of judgments. Rather, we will guide you on what matters and help you focus on just that. Seconds we help you plan your day, week and month by curated monthly planners and specialized subject trackers. For example, this month we are focusing on minor subjects. So you can cover six subjects well in just one month. Third, and the feature I like most, is that through the

6:58 process you get one-on-one mentorship. So what are the important and relevant topics this year? How to fill the exam form? How to choose specialization regarding this? You get to ask, discuss anything and everything around CLAT. Many more tools are provided. Like the most loved feature is the quick format review videos. So if you are preparing for CLAT PG, you will get all the information about this course here and in the description below. Do check out our course. Now we have come to the most important part of this video where we are going to discuss important judgements one by one. So the first case is of Mehnoor Fatima which is related to the property case. There are very important facts and in this case the Supreme Court has not said anything new but has only reiterated the already established facts. So what happens in this case? We will understand it very simply. You will easily understand

7:44 that A has a property which he sells to B in 1982 and for which he also makes a sale agreement. Now should they get this sale agreement registered? No. What does our law say on this point? So sections 17 and 49 of the Registration Act 1908 state that registration is compulsory for the title transfer of any property to be complete. If the document is not registered then it cannot be used as evidence in court further. Due to which your ownership will not be established further. So registration is compulsory. Was the registration done here ? No. Meaning, is the title that B got valid? No. So what happens next is that B, who himself does not have a valid legal title, sells the same property to a builder and gets this sale agreement registered. So

8:31 this transaction gets registered. Further, the builder also sells it to Mahnoor Fatima and he also gets this sale agreement registered. So the further transactions were registered but the root agreement was not registered. So if the root is bad then how can the fruit be good? And this is what the Division Bench of the Supreme Court said that since the main agreement of 1982 was invalid, the future transactions are also invalid. So in this case the Supreme Court said that to establish the ownership of any property, it is necessary to have a lawful and valid title. Ownership cannot be established by mere registration. It is important to have a valid title. After this, the second important judgement is the latest Supreme Court case of Amlesh Kumar vs State

9:16 of Bihar in which the validity of Narco test detected test has been discussed. So what happens in this case? The accused is charged with murder and threat of harassment. When he applies for bail in Patna High Court, the police says that we have to collect more proof and evidence in this case. For which we want to conduct Narco analysis test on the accused and the High Court also allows it. Now two questions arise here. What is the first narco analysis test? And secondly is it valid in India? is it acceptable? So in Narco test a drug called Sodium Pentothal is induced. After which the person also starts speaking his subconscious thoughts. So this is a kind of truth serum. Secondly, is it valid in India ? So the leading case on this topic, the landmark case is Selvi versus

10:01 State of Karnataka which is a 2010 judgment. In this case, the Supreme Court established two very important things very clearly. First, forcibly subjecting the accused to narco analysis test. His right to personal liberty and right against self-incrimination. This would mean that Article 21 and Clause 3 of Article 20 would be contradictory. There will be violation. Second, conducting a narco test or lie detected test without consent. There will also be violation of mental privacy. But in this case an exception has also been given that if the accused wishes to give these narco tests voluntarily on his own will then it can be allowed under these strict conditions. Now we come to our present case. So in the case of Amlesh Kumar, the Supreme Court first said that it is wrong to allow test in the matter of bail. Secondly, the court raised a very

10:47 interesting question and that is what makes this case different. The court asked whether an accused can demand a narco test for his own defence to prove his innocence? What? The court said yes, if the accused is presenting evidence at the time of trial then he can request for narco test. But keep in mind that this request is not an absolute right. Meaning, if the court wants, it can even deny it. So why is this case important? Because it was said that if the court allows, the accused can get the narco test done on his own will. Now look, you must be aware that whether it is law school or any exam, judgments and legal updates play a very important role. And keeping this very factor in mind, we have designed the Most Stable Judgement Course which gives you two major benefits straight away. The first is judgements. So, if you need a quick summary of

11:33 all the important judgements to be made this year, plus all the landmark decisions from 2018 to 2025, through detailed video analysis, then if you want to test yourself through case summaries, you will also get specific assessments for each case. Plus monthly legal updates are also covered in a quick revision format. So all those things which are necessary for you to stay legally updated plus much more, everything is covered in this course on Most Important Judgment. You will get all its details here and in the description box below. Do check it out. Now we are going to learn about a new type of right taking the example of Amitabh Bachchan, Shahrukh Khan and Rajinikanth. Which can also become your next research or project topic. So friends, this unique style, this distinct identity of theirs is

12:20 their asset which we legally know as personality right or publicity right. Which says that their voice, unique style, their look, appearance and image cannot be unauthorizedly accessed or misused commercially. Now this is one side. On the other hand, there is a survey which says that 38% of Indians have been subjected to deep fake scam. Where using AI, such images, audio, videos are generated that look absolutely real. And something similar happened with Sadhguru. Where using AI tools, using their voice , using video looks, misleading messages were created for commercial purposes. Against which Sadhguru approaches Delhi High Court to protect his personality rights. Now, the laws regarding personality rights in India are not very clear.

13:06 Whatever protection is available is mainly under Article 21. Within the right to privacy and personal liberty and within the concepts of passing off and defamation in tort law. So, this case law is important because, first of all, the High Court has considered Sadhguru's world style, his image, his appearance as his unique identity. And saying this he ordered to suspend all the YouTube channels and websites. Who were producing misleading messages using AI tools and infringing the personality rights of Sadhguru. So this case is important because in this protection was granted to personality rights. Now you ca n't do one activity. You can do a mock debate with your friends. Saying that all these famous personalities are actors, if someone does comedy or mimicry by taking their unique style, their dialogue delivery style, will that be

13:55 covered under the freedom of speech and expression or will it be an infringement of their personality rights? Try it and you will learn many things. Next up is the Iran Israel War in which Israel launched Operation Rising Lion and directly attacked Iran's nuclear plants and military sites. What Israel wanted was that Iran should not be able to make nuclear bombs. Now why is there a war between Iran and Israel ? What is its history ? Let's quickly understand through the world map. Now to understand this, let us first look at the world map. So this is our India and if we go to the Middle East, there is Iran, Israel and Palestine. Now Iran and Israel have a 40 year old rivalry. In fact, since the Islamic Revolution of 1979, Iran considers Israel an illegitimate country, saying that Israel is

14:42 built on Palestinian land. Due to which Palestinians are being oppressed and Iran considers itself the protector of Palestine. Because of this, Iran supports every group that is fighting against Israel. Like Hamas from Gaza, Hezbollah from Lebanon , Militia from Syria and Houthis from Yemen who have surrounded Israel from all sides. Iran provides money, weapons and training to these proxies to fight the war indirectly so that it does not have to enter the battlefield directly. And that is why Israel wants to eliminate these proxies so that Iran loses control in the Middle East. After this, the Air India flight flying from Ahmedabad to London crashes near Sardar Vallabhbhai Patel Airport in Ahmedabad. In which 250 people

15:27 die. This incident affected all of us deeply. Why did the plane crash ? Its investigation is still ongoing. But what laws govern such incidents ? Let us understand this. So there are two main laws in incidents like air crashes. One is the International and Montreal Convention which has been created to uniform the rules of international air travel. Of which India is a party since 2009. This law is applicable on international flights. And India's law is based on the rules of this convention. Carriage by Air Act. The government says that the rules of the convention will also be applicable to domestic flights. Both these laws follow the law of strict liability. Which simply means that no matter who is at fault during the flight, if a passenger gets injured or dies, the victim or their family will be given a compensation of Rs 1.85 crore

16:14 as per the Montreal Convention and Rs 1.32 crore as per the Carriage by Air Act. So the Tata Group or Air India which has given compensation of Rs 1.25 crore to the families of the victims will also have to match this value. So there are two lodges here. One is the Montreal Convention and the other is India's Law Carriage by Air Act. So this was this month's legal update video. I hope you have learned something new in today's video. If you have any doubt, suggestion, query related to this video or any other topic, do let me know in the comment section and I will write back to you. That's it for now. See you the next class. Bye bye.
