Brief Summary

The Kenyan Ministry of Health is working on the Quality of Health Care Bill and patient safety measures. The bill aims to establish an agency to oversee patient care and quality, ensure patient rights, enforce national standards across all health facilities, and introduce a rating system to recognize high-standard facilities and help struggling ones improve. The goal is to protect patients, ensure they are treated with dignity, and provide avenues for addressing grievances.

  • Focus on patient rights, safety, and quality of care.
  • Establishment of an oversight agency for patient-related issues.
  • Enforcement of uniform national standards across all health facilities.
  • Introduction of a rating system for health facilities to promote improvement.

Introduction to the Quality of Health Care Bill

The Ministry of Health is conducting public participation for the Quality of Health Care Bill and patient safety initiatives. This bill complements existing legislation such as the Social Health Insurance Financing Act, the Digital Health Act, the Primary Healthcare Act, and the Facility Improvement Financing Act, which primarily focus on infrastructure, financing, and commodities. The new bill aims to protect patients by establishing an agency to oversee patient care and quality, ensuring clean facilities and dignified treatment.

Patient Rights and Redress Mechanisms

Every patient will have the right to safe care, privacy, informed consent, and avenues for complaints and redress. The ministry aims to address the issue of patients, such as pregnant mothers, being neglected in health facilities. As the regulator, the ministry will inspect facilities to ensure quality care is provided and address any issues raised by patients.

Enforcement of National Standards

The bill seeks to enforce national standards across all health facilities, regardless of ownership (public, faith-based, or private). Due to the devolved system of government, standards currently vary. The goal is to ensure that all facilities meet the same minimum quality standards.

Introduction of a Rating System for Health Facilities

A rating system will be introduced to recognize and reward high-standard facilities, while also identifying gaps in struggling facilities to promote improvement. This system aims to encourage all facilities to enhance their quality of care.

1:07 Kenya. We are in the process of having public participation for the quality of health care bill and patient safety. The ministry of health has already uh come up with follows initially that is the uh social health insurance financing act of 2023. We have the digital health act of 2023. We have the primary healthcare act of 2023. And we have facility improvement financing act of 2023. And when we look at all these acts, they are talking about infrastructure ring

1:53 fencing financing and uh commodities. But we have really not gone deeper to know to protect the patient. That is why we we have come up with the quality of health care bill, quality of health care and patient safety bill. And one of the things that we are going to do with this bill is to ensure that we have an agency that oversightes all issues to do with patient care, patient quality. We want clean facilities. We want the patients to be treated with dignity and um the every patient uh will have a right to to safe care and privacy, informed consent

2:38 and complaints for redress. I it breaks my heart when sometimes I see patients and especially pregnant mothers rolling on the floor and nobody is really looking up to them. We want somewhere that patient can be able to have a red address of the issues that they have uh taken place in that health facility and because we are also the regulator we will be able to go to those facilities and and check what is the quality of care that is being given in those facilities. The second thing that we also want to do is to ensure the third thing is to ensure that the national there's enforcement of national standards. Many of times because of the devolved systems of government we we

3:24 find that uh maybe facilities at the county level and uh others owned by the national government. We have facilities that are owned by private individuals. Others are even owned by faith-based institutions. But we find the standards are haphazard and they are not uh to the to to to the norm. Therefore we want all the health facilities whether it is public faith-based or private they must meet the same minimum standards uh of quality. The other one is to ensure that we introduce the the the ratings because if you do well you must be pat somebody on the back and tell them hey

4:10 you have done well. So we will introduce rating of these facilities the ones who have high standards and the ones who are also struggling so that they can know what are the gaps that they need to put into and improve or the sim. Mhm.
